R U L I N G

The Applicant on 18th October, 2017, instituted the instant action for the enforcement of her fundamental human right pursuant to Article 33(1) of the Constitution of the Republic of Ghana, 1992 and Order 67 of the High Court (Civil Procedure) Rules, 2004 (C.I. 47).

In the affidavit accompanying the originating action, the Applicant states she is a 38 year old woman currently residing in London. She further states that between the years 1991 to 1994, her mother, who used to travel around a lot, left her in the care of the Respondent who was a tenant in her mother’s house in a suburb of Kumasi.

According to the Applicant, she was then 12 years old and during those times, the Respondent on several occasions abused her sexually, as a result of which she has suffered some silent emotional pains for the past 25 years.
