Judgement

JOSEPH EYO EKANEM, J.C.A. (Delivering the Leading Judgment): The appellant was arraigned before the High Court of Justice Benue State, holden at Makurdi in charge No. MHC/132C/2007. He was the 2nd accused person in the information. The information contained a three count charge as follows:

"COUNT ONE:

That you, Solomon Bem Kwenev 'M' and Justine Terdooo Ishor 'M' on or about the 25th day of March, 2006 in Agasha town in Guma Local Government Area of Benue State within the jurisdiction of this Honourable Court agreed to do an illegal act to wit: rob one Keghtor Igyel 'm' now deceased of his motorcycle and the same act was done in pursuance of the said agreement and you thereby committed an offence punishable under Section 5(b) of the Robbery and Firearms (Special Provisions) Act, Cap 398 Laws of the Federation of Nigeria 1990.

COUNT TWO

That you, Solomon Bem Kwenev 'M' and Justine Terdoo Ishor 'M' on or about the 25th day of March, 2006 at near Tse-Tser compound, Mbakya, Mbachonhul in Tarkā€¦
