OGEBE, JCA (Delivering the Lead Judgment): The respondents sued the appellants in the High Court of Rivers State seeking in paragraph 41 of their statement of claim, the following reliefs:

“(a) A declaration that the purported suspension and removal of Emmanuel Osaro-Lai as the Chairman and President of Zone C, Port Harcourt of the Nigerian Welders Association by the defendants is unconstitutional, null and void and of no effect ; A declaration that the manner and procedure taken in making the purported suspension and removal of Emmanuel Osaro- Lai as the Chairman or President of Zone C, Port Harcourt of the Nigerian Welders Association is against the principles of natural justice and fair hearing. An order restraining the 1st plaintiff, Emannuel Osaro-Lai as Chairman or President of the Nigerian Welders Association.
