UWAIS, J.S.C. (Delivering the Leading Judgment): The appellant was the plaintiff in the Federal High Court holden at Enugu, where he instituted an action against the respondents as defendants. In the action the appellant claimed as follows, as per paragraph 12 of his statement of claim:-
"Whereof the plaintiff claims against the defendants jointly and severally as follows:-
(1) A declaration that the purported removal of the plaintiff as Executive Director of the 2nd defendant by the 1st defendant is ultra vires, null and void and of no effect.
(2) An order compelling the 1st defendant, his servants and/or agents whatsoever to restore all the aforesaid entitlements legally due to the plaintiff as such Executive Director.
