AMIRU SANUSI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling of the National Assembly/Governorship and Legislative Houses Election Tribunal, Imo State of Nigeria, (herein after referred to as the Tribunal) holden at Owerri in Imo State of Nigeria dated 27/06/2003. On the 19th day of April, 2003 elections were held into the Gubernatorial seats throughout the Nigerian Federation. Out of the 30 registered political parties, ten of them presented candidates to represent them at the said elections as governorship candidates. Among the candidates were the appellant Engineer Dr. Izuogu who was fielded by the All Progressive Grand Alliance (APGA) who was the petitioner at the lower Tribunal and the 1st respondent, Chief Achike Udenwa, who represented the peoples democratic Party (PDP).
