(Delivering the Leading Judgment): The appeal is against the decision of the Court of Appeal, Kaduna Division(lower court), delivered on the 31st March, 2017 by which the appellant’s appeal against the decision of the High Court of Justice, Kaduna State was dismissed. Briefly, the facts giving rise to the appeal are that the 1st respondent, as plaintiff, sued the appellant in respect of a piece of land at the Zangon Kataf Sharia Court which entered judgment in favour of the appellant at the end of the trial. Dissatisfied, the 1st respondent appealed against that decision, to the Upper Sharia Court, Saminaka which allowed the appeal and set aside decision of the Sharia Court, Zangon Kataf.
