Judgement

PAUL OBI ELECHI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the decision of Honourable Justice J.W. Jauro of the Yobe State High Court (Potiskum Judicial Division) delivered on the 29th day of July, 2016 wherein the trial Court delivered it's Judgment against the appellant.

The Appellant being aggrieved by the decision of the trial Court, appealed to this Honourable Court filing 3 grounds of appeal and formulating one issue for determination.

The Appellants story is that they inherited the farmland subject matter of this appeal from their father about 56 years ago. That after the demise of the father of the appellants, the 1st appellant was taking care of by his uncle Ibrahim Dumza Chesu, away from Garin Jala and settled at Bilal, Dambam and entrusted the farmland in dispute to Bulama Abaye. That after some years when the 1st appellant and his uncle requested for the farmland they gave in trust but the respondents informed them that they cannot give him the farm…
