J U D G M E N T 

Plaintiffs’ case 

By a writ of summons issued on 16th September 2019, the plaintiffs claimed the  following reliefs against the defendant: 

i. An order of perpetual injunction restraining the defendant either by himself  or by his workmen, assigns and privies from trespassing on plaintiffs’ lands  described in the statement of claim and from doing anything to prevent  plaintiffs from continuing with construction works on the land. 

ii. Damages for trespass. 

iii. Cost inclusive of solicitor’s fees. 

The land was described in paragraphs 3 and 4 of the statement of claim as “all that  piece and parcel of land situate, lying and being at North Achimota in the Ga District  and bounded on the North West by a road from St. Johns to Kwabenya measuring 76.0  feet, on the North East by vendor’s land measuring 204.6 feet, on the South East by  vendor’s land measuring 87.2 feet and on the South West by vendor’s land measuring  198.4 feet and covering an area of 0.32 acre or 0.13 hecta…
