Judgement

JOSEPH SHAGBAOR IKYEGH, J.C.A. (Delivering the Leading Judgment): The appeal is from the judgment of High Court of Justice of Lagos State (the Court below) whereby it convicted the appellant for the offences of conspiracy to commit armed robbery and armed robbery contrary to Sections 297 and 295(2)(a), respectively, of the Criminal Law of Lagos State 2011 upon which the appellant was sentenced to death by hanging.

In summary, the case for the respondent was that about 3a.m. of 17.02.12, the appellant and others at large while armed with a gun and cutlass robbed one Olarewaju Falowo (female) of her jewelries valued N100,000.00 and her husband of car keys, cards and phones.

On the other hand, the appellant denied in his evidence on oath that he participated in the alleged armed robbery. The Court below believed/accepted the version of the respondent and convicted the appellant as charged.
