AMINU ABBA JEGA V. BASHAR ADAMU JEGA

MUHAMMED LAWAL SHUAIBU, J.C.A. (Delivering the Leading Judgment): This appeal emanated from the judgment of the Sharia Court of Appeal Birnin Kebbi, Kebbi State delivered on the 6th day of March 2024, affirming the concurrent judgment of the Sharia Court and Upper Sharia Court respectively.

The Respondent instituted a civil suit at the Sharia Court, Jega, against the Appellant, claiming a piece of land situated at the Dabagi, behind the College of Health Technology, Jega. At the trial, both parties presented witnesses and tendered their respective letters of grant issued by the Ministry of Land and Housing, Kebbi State. In the end, judgment was entered in favor of the Respondent.

Aggrieved with the trial Court's judgment, Appellant appealed to Upper Sharia Court, Jega which affirmed the decision of the trial Court. Appellant further appeal to the lower Court was however, dismissed at page 33 of the record as follows:
