JUDGMENT 

TETTEH-CHARWAY, J.

The Plaintiff, Jessie Akofa Mantey-Ocansey, caused her lawyers to issue a writ of summons  against the Defendants, Dr. Ametefe Mawuli Kwami and Dr. Vincent Boima for the following  reliefs; 

a) A declaration that Plaintiff is the equitable owner of H/No. 168 Exodus Avenue  East Legon Hills, Katamanso Accra. 

b) An order setting aside the auction in respect of H/No. 168 Exodus Avenue East  Legon Hills, Katamanso Accra. 

c) Damages for wrongful attachment and auction of the property. 

d) Perpetual injunction restraining the Sheriff of the Court, the Defendants, their  agents, servants, assigns, privies or by whomsoever claiming through, under or in  trust for the Sheriff and Defendants from interfering in anyway whatsoever with  Plaintiff’s property. 

The Plaintiff’s case, as gleaned from her statement of claim, is that on 25th July 2005, she  entered into a contract with Commercial Investments Ltd, a Real Estate Company, to acquire a house. By the terms of the co…
