<p class="ql-align-center">RULING OF THE COURT</p><p class="ql-align-justify">The notice ofmotiondated 3^rd February,2012 arises from the Ruling and Order of the learned Judge of Kenya <em>(Hon. Mabeya, J.)</em> dated 20^th January, 2012 given in <em>H.C.C.C. No. 73 of 2007</em>. It is expressed to be premised under <em>Rule 5 (2) (b),Rule 41, Rule 42 Subrule (1) and Rule 49 (1)</em>of Court of Appeal Rules and <em>Section 3A and 3B of the Appellate Jurisdiction Act (Cap 9)</em>.
