NNAMDI OKWY DIMGBA, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling of the High Court of Justice of Adamawa State, Gombi Judicial Division (trial Court) in Suit No. HC/ADSY/85M/2024 delivered by Ahmed Isa J. on 08/07/24 wherein the trial Court dismissed an application for certiorari made by the Appellant for being defective. The Notice of Appeal was filed on 09/08/24 and contains 3 (three) grounds (p. 93 - 99 of the Record). The Record of Appeal was transmitted on 13/11/24, paving the way for the filing of the Appellant’s Brief of Argument on 13/12/24, but deemed properly filed and served on 16/01/25. This was settled by S. G. Udoh, Esq. The Respondent filed no brief and was not legally represented, and so this appeal is being determined on the Appellant’s Brief of Argument alone.

When the appeal came up for hearing on 18/06/25, learned counsel for the Appellant adopted his brief of argument as earlier identified, and the matter then reserved for judgment…
