Judgement

SHUAIBU J. (Delivering the Lead Ruling): Pursuant to Order 30, rules 3(1) and (2) of the Federal High Court (Civil Procedure) Rules, 2000 and the inherent jurisdiction of the court the plaintiff/applicant prays for:-

1. An order granting leave to the plain tiff/applicant to discontinue the suit herein against all the defendants.

2. An order striking out the suit herein.

3. And such further order or orders as the Honourable Court may deem fit to make in the circumstances.

The motion is supported by 6 paragraphs affidavit deposed to by one Ukpabio Okon; a Litigation Assistant in the plaintiff’s firm of solicitors. Attached to the affidavit is a copy of the front cover of the new publication of “All Federation Weekly Law Reports”, marked exhibit A.

The kernel of the plaintiff/applicant’s case is comprehensively stated in paragraphs 3 - 5 of the supporting affidavit which state as follows:-
