STEPHEN J. ADAH, JCA (DELIVERING THE LEADING JUDGMENT): This is an appeal against the judgment of the High Court of Akwa Ibom State, Eket Judicial Division in suit No. HEK/15/2013 by T. I. Obot, J. on the 24th day of June, 2013.

The case was originated on the 4th day of February, 2013, when the Appellant filed an Application for the enforcement of his Fundamental Rights at the Lower Court against the Respondents.

The said application was supported with a Statement of Facts and an Affidavit, which was deposed to by Sambo Asuquo Usoro, a junior Counsel in the Law firm representing the Appellant in the case. The Appellant later deposed to a Further Affidavit in reaction to the 1st Respondent's Counter Affidavit.

The relief of the Appellant in that application is expressed as follows:

(a) A declaration that the allegation contained in the 2nd and 3rd Respondents' letter of invitation dated 1st February, 2013 that the Applicant is suspected of kidnapping is a false and malicious report in that…
