JUDGMENT
ASARE-BOTWE (MRS.), J.
By an amended writ of summons and accompanying statement of claim the Plaintiff claimed against the Defendant for the following reliefs;
a) Declaration that defendant breached sale agreement by failing to deliver a durable, strong and quality equipment to the plaintiff.
b) An order directed at the defendant to refund One hundred and Ninety five thousand, three hundred and seventy Ghana cedis (GH₵ 195,370) to the Plaintiff being payment made so far to the defendant on the equipment.
c) Interest on the said GH₵ 195,370 from May 2014 to date of final payment.
d) Order directed at defendant to pay an amount fifty thousand Ghana cedis (GH₵50,000) to the Plaintiff for maintenance expenditure made on the equipment.
e) Costs on full indemnity basis
f) Any other relief or reliefs the court may deem fit.
Upon filing an amended defence, the Defendants also counterclaimed as follows;
a. An order directed at the Plaintiff for the recovery of the outstanding debt …
