<p> </p><p> </p><h2 class="ql-align-center">JUDGMENT </h2><p><strong>ASARE-BOTWE (MRS.), J.</strong></p><p>By an amended writ of summons and accompanying statement of claim the Plaintiff claimed against the Defendant for the following reliefs; </p><p>a) Declaration that defendant breached sale agreement by failing to deliver a durable, strong and quality equipment to the plaintiff. </p><p>b) An order directed at the defendant to refund One hundred and Ninety five thousand, three hundred and seventy Ghana cedis (GH₵ 195,370) to the Plaintiff being payment made so far to the defendant on the equipment. </p><p>c) Interest on the said GH₵ 195,370 from May 2014 to date of final payment. </p><p>d) Order directed at defendant to pay an amount fifty thousand Ghana cedis (GH₵50,000) to the Plaintiff for maintenance expenditure made on the equipment. </p><p> </p><p>e) Costs on full indemnity basis </p><p>f) Any other relief or reliefs the court may deem fit. </p><p><strong>Upon filing an amended defence, the Defendants also counterclaimed as follows;</strong> </p><p>a.
