ADZIRA GANA MSHELIA, J.C.A. (Delivering the Leading Judgment): This appeal is against the Ruling of the Bauchi State High Court delivered on 2nd June, 2010 by Hon. justice Hamidu N. Kunaza. By a writ of summons dated 7th September 2009, the plaintiff now appellant commenced an action at the High Court of justice Bauchi State, claiming his unpaid legal fees against the Defendant/Respondent as follows:

1. The sum of N550,000.00 (Five Hundred and Fifty Thousand Naira).

2. 10% post judgment interest from the date of judgment until final satisfaction.

3. Cost of action.

The appellant sought and obtained leave for the matter to be placed under the undefended list and to serve all the processes of Court on the Defendant/Respondent. On 29th September 2009 when the matter came up for hearing the Defendant/Respondent did not appear in Court.
