Judgement

MUKHTAR, JCA (Delivering the Lead Judgment): The suit in the court below (that culminated in this appeal) originally had Bulama Buba Dangwa, Alhaji Adamu Nido and Tukshehe Kara (suing for themselves and on behalf of the ville clan) as plaintiffs on one hand;and Lawan Buba Wasa (suing for himself and as representative of the people of Kurana Bassa, Gwoza Traditional Council and Gwoza Local Government Council as defendants.

On appeal, it seems only Tukshehe Kara appealed (as is reflected in the notice of appeal). The 1st defendant Lawan Buba Wasan became deceased, and in his place was substituted Lawan Abdullahi Buba Wassan, the successor-in-title to the 1st defendant/respondent by the order of this court of 9/5/2001. Briefly put, the case of the plaintiffs, as per the statement of claim, is that the 1st defendant is the head of Kurana Bassa hill dwellers who came to the plaintiffs’ village Ville to stay temporarily.
