KASIDO NIGERIA LIMITED V. ACCESS BANK PLC

STEPHEN JONAH ADAH, JCA (Delivering the Leading Judgment): This appeal is against the Ruling of the Federal High Court, Abuja, Division in Suit No. FHC/ABJ/PET/02/12, delivered on the 6th day of June, 2013, by I.N. Auta, (C.J).

Before the lower court, the Respondent in this appeal filed as the Petitioner, a Petition seeking an order of the court to Wind Up the appellant - Kasido Nigeria Ltd. The appellant who was then the respondent filed a notice of preliminary objection challenging the jurisdiction of the lower court to entertain the Petition for the reason that the Petitioner failed to effect proper service of the Originating Processes on the appellant. The objection was contested by the parties. The court after looking into the arguments of the parties and the facts before it overruled the objection of the appellant. The court thereafter granted the petition winding up the appellant.
