IBRAHIM LIMAN KATAGUM & ANOR V. ALHAJI DANLADI ME-MAI

TIJJANI ABDULLAHI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling of High Court of Justice Bauchi State in Suit No. BA/63/2004 delivered by Hon. Justice S.S. Darazo (CJ) (as he then was) on the 22nd day of April, 2010.

By a motion on notice dated and filed on the 28th day of May, 2008, the Respondent, as Judgment Debtor/Applicant, brought an application praying for the following reliefs:

1. AN ORDER granting leave to the applicant for the extention of time to apply for the setting aside of the sale of his parcel of land laying (sic) situate at liman katagum in Bauchi State.

2. AN ORDER granting extension of time to the Applicant to set aside the sale of Applicant's parcel of land situate along Bununu - Bauchi road, Liman Katagum, Bauchi Local Govt. Area on the 7th November, 2005, when the notice of such sale was never served on the Applicant or his counsel.
