FAKUA KEHINDE V. THE STATE

PETER CHUDI OBIORAH, J.C.A. (Delivering the Lead Judgment): This is an appeal by the Appellant against the judgment of the Ondo State High Court of Justice, Akure Judicial Division presided over by Hon. Justice Yemi Fasanmi delivered on the 16th day of July, 2021.

BACKGROUND OF FACTS

On 6th September, 2017, at about 7:00 p.m., a woman, Mrs Roseline Ogunjemiyo (PW2) and her daughter, Omolola Ogunjemiyo (PW1), aged about 14 years, were returning home from their shop in a Toyota Camry vehicle and upon parking their car, they were approached by three unmasked men.

The assailants robbed the woman of her car and the sum of ₦80,000.00. The woman, Mrs Roseline Ogunjemiyo reported the matter to the police stating that she suspected the person who sold the Toyota Camry car to her and his boys as the robbers.
