RULING

Before me is a Notice of motion dated 10^th December, 2018 and filed on 18^th December, 2018, expressed to be brought under Rule 4 of the Court of Appeal Rules (CAR), seeking relief as follows:

“(1) That the Honourable court be pleased to extend time within which the applicants can file and serve a record of appeal herein.

(2) That costs of this motion be provided for.”

It is supported by a supporting affidavit of Kimol Ruto and Esther Ruto, deposed on 10^th December, 2018. It is opposed by replying affidavits deposed by Samuel Kipkosgei Keitany, the 1^st respondent on 13^th July, 2019, and filed on 15^th July, 2019, on his own behalf, Rashid Ngaira deposed on 22^nd July, 2019, and filed on 23^rd July, 2019 on behalf of the 4^th respondent, and lastly on points of law by learned counsel Mr. Wabwire, for the 5^th and 6^th respondents.
