ABBA BELLO MOHAMMED, J.C.A. (Delivering the Leading Judgment): The suit giving rise to this appeal which had a chequered history was instituted before the High Court of Oyo State vide a writ of summons dated and filed on 1st December, 1995. After a sojourn to the Court of Appeal, it was returned for trial de novo. In the suit, the Respondent as Plaintiff sought for the following reliefs against the Appellant as Defendant:
1. DECLARATION that the Plaintiff is the Chief Imam of Igboho in Oorelope Local Government of Oyo State and he is the one entitled to all the rights and privileges, power and honour attaching to or appertaining to that office.
2. INJUNCTION restraining the Defendant by himself, his agents, servants and or privies or otherwise howsoever from further parading himself or acting as or holding himself out as or performing the functions of the Chief Imam of Igboho.
