ESSIEN J (DELIVERING THE JUDGMENT): By a complaint dated and filed on the 21/01/2019 the claimant sought the following reliefs from this court:-

1) A DECLARATION that, by virtue of total disregard for due process by the defendant, all the decisions taken by the said defendant against the claimant, leading to the dismissal from service of the claimant, are arbitrary, unlawful and contrary to relevant provisions of Public Service Rules, NUC Conditions of Service and the Constitution of Federal Republic of Nigeria.

2) AN ORDER of the court directing the defendant to comply with the relevant statutory obligations provided in the Public Service Rules 2006 (i.e. Section 030302 – 030307) and NUC Conditions of Service (Chapter X Section 2.4) which are consequential to the rescission of the unlawful dismissal of the claimant and which provisions (as precedent) the defendant had used for some employees who had been sanctioned/dismissed for training related offences, but who have now been reabso…
