<p>TANI YUSUF HASSAN, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of High Court Minna, Niger State delivered on 22nd January, 2016 in Suit No. NSHC/MN/152/2010 by Hon. Justice Fati L. Abubakar.</p><p>The appellant as plaintiff at the lower Court instituted an action by a Writ of Summons and Statement of claim dated 11th September, 2010 and filed on 16th September, 2010 against the respondent as defendant therein.</p><p>The plaintiff claims from the defendant a declaration of title to the land at Gurunkunkun; general damages for trespass and a perpetual injunction restraining the defendant, his privies, servants and agents from farming on the land.</p><p>The defendant/respondent with the leave of Court filed a statement of defence and counter claim on the 24th of January, 2012.</p><p>The case went into trial and at the conclusion, judgment was entered in favour of the respondent.</p><p>The appellant who is dissatisfied appealed to this Court.
