This appeal emanates from the judgment of the High Court, Kumasi dated 31st August 2008 which convicted the Appellant for the offence of stealing, fraudulent breach of trust and defrauding by false pretences contrary to Sections 124 (1), 129 and 131 respectively of the Criminal Act, 1960, Act 29. The Appellant, aggrieved at the said conviction and sentence filed an appeal on four grounds as follows:
“1. The judgment is against the weight of the evidence.
2. The court erred when it held that the prosecution had proved its case beyond reasonable doubt.
3. Mitigation of sentence.
4. Additional ground of appeal will be filed upon receipt of the Record of Appeal.”
However, no additional ground of appeal was filed by the Appellant when he received a copy of the record. The facts as presented at the trial court were as follows:
