Judgement

CHUKWUMA-ENEH, JCA (Delivering the Lead Judgment): It is against the decision of the Plateau State High Court in suit No. PLD/J163/ 87 delivered byAhniche J., of blessed memory, dismissing in its entirety the plaintiff’s claim against the respondent (as defendant) that the plaintiff (as appellant) has now appealed to this court, relying on 4 (four) grounds of appeal. The gist of the appellant’s claim at the trial court as set out in the said judgment of 3/12/93 is as follows:

“The plaintiff claims from the first defendant the sum of N20,000.00 as special damages under the following particulars:

Destruction of 10 trees of local peer valued at N2,000.00

Destruction of 20 trees of guava valued at N3,000.00.

Destruction of 50 tress of mango valued at N10,000.00

Destruction of 10 trees of mahogany valued N30,000.00

(5) Destruction of 50 trees of cashew nuts valued at N2,500.00
