Judgement

DANIEL-KALIO JCA (Delivering the Lead Judgment): Before this court is an appeal against a ruling of the National and State Houses of Assembly Election Tribunal sitting in Ibadan delivered on Tuesday, 23 June 2015. The ruling was delivered in respect of a motion on notice filed by the 2nd and 3rd respondents, that is, the Independent National Electoral Commission and Mr. Rufus Oluwatoyin Akeju, the Resident Electoral Commissioner, Oyo State.

They had prayed the Election Tribunal for the following:

An order allowing the motion on notice to be moved outside the pre-hearing session.

An order for enlargement of time within which the A 2nd and 3rd respondents may file their reply to the petition dated and filed on 18 April 2015.

An order deeming as properly filed and served, the 2nd and 3rd respondents’ reply already filed and served.
