Judgement

OGUNTADE, JCA (Delivering the Lead Judgment): In suit No. FHC/L/CS/1274/99, the appellants as the plaintiffs commenced a suit against the respondents as the defendants claiming the following reliefs:

(i) A declaration that under and by virtue of the bidding requirements/conditions for the sale/acquisition of National Bank of Nigeria Limited, the plaintiffs had duly satisfied and complied with the said requirements and conditions stipulated therein.

(ii) A declaration that the plaintiffs are the bona fide successful bidders for the acquisition of the National Bank of Nigeria Limited and consequently entitled to the ownership, management and control of the bank.

(iii) A declaration that under and by virtue of the bidding requirements for the sale/acquisition of National Bank Limited, the 4th and 5th defendants did not satisfy or comply with all the conditions/requirements stipulated for the acquisition of the bank.
