HAMMA AKAWU BARKA, J.C.A.(Delivering the Leading Judgment): This appeal is against the ruling of M.A. Folayan J. of the Kwara State High Court of Justice Ilorin, in suit No. KWS/140/2015, between Alhaji Abdulhakeem Adelaja Amao against the Labour Party and five others, delivered on the 15th of October, 2015.

The claimant/Applicant, Alhaji Abdulhakeem Adelaja Amao before the Lower Court and by way of an originating summons sought for the determination of the following questions.

1. Whether in view of the provisions of Article 27(3)(i) and (ii) of the Constitution of the Labour Party (LP), regulating the holding and conduct of the party's primary election for the nomination of governorship candidate, Section 87 (1) and (4)(b)(i) and (ii) of the Electoral Act 2010 as amended, and the Report of the Kwara State Labour Party Governorship and House of Assembly primary Election held on 10th December, 2014 in which the claimant was the sole contestant, and duly returned as Kwara State Governorsh…
