OKORO JCA (Delivering the Lead Judgment): This is an appeal against both the ruling and judgment of the Lagos State High Court in suit No. LD/1146/09 both delivered on 18 June 2010 by Hon. Justice D. T. Okuwobi. The appellant is a corporation wholly owned by the Lagos State Government for the provision of water to the general public in Lagos State. The respondent is a company registered under the Companies and Allied Matters Act, 1990, carrying on construction work in Nigeria. Some time in 1994, the appellant employed the services of the respondent for the execution of a contract for the supply and laying of secondary tertiary network system under the appellant’s water supply expansion programme.
