Judgement

ABOKI JCA (Delivering the Lead Judgment): This is an appeal against the ruling of the Federal High Court Abuja, delivered on 10 March 2006 by F. Nyako J.

The facts of the case are that the appellant as plaintiff in the lower court instituted an action against the defendants claiming that:

“28. Whereof the plaintiff claims against the defendants jointly and/ or severally as follows:

A declaration that there is a valid and subsisting contract between the plaintiff on the one hand and the 1st and 3rd defendants on the other hand. An order directing the 1st and 3rd defendants to pay N39,500.000.00 to the plaintiff same being the amount expended by the plaintiff in carrying out the assignment.

An order directing the 1st and 3rd defendants to pay the sum of N4.16 Billion to the plaintiff same being and representing 1/3 of the total revenue received by the 1st and 3rd defendants from the Federal Government in respect of the 54 oil wells from 2000-2004.
