(DELIVERED BY JAMES SHEHU ABIRIYI, J.C.A) This appeal is against the judgment delivered on 28th September, 2017, in the High Court of Adamawa State sitting at Yola. In the High Court (Court below), the Appellant was the Plaintiff while the Respondents were the Defendants. The claim of the Appellant was for a declaration that he is the owner of a parcel of land known as Plot No. 3H Road measuring 1350 square metres based on GYSP 38 Yola, Government Layout at Yola Town adjacent Shagari Housing Estate. 2) An order of perpetual injunction restraining the Respondents from interfering with the Appellant’s ownership and possession of the land. 3) 2 Million Naira special and general damages against each of the Respondents and 4) N500, 000.00 as costs of the action. According to the Appellant, when he started work in 1993, he tried to get a plot of land to build on and Ministry of Lands and Survey gave them a plot of land in Yola Town.
