<p class="ql-align-justify"><strong><span style="background-color: transparent">UGOCHUKWU ANTHONY OGAKWU, JCA (Delivering the Leading Judgement): </span></strong><span style="background-color: transparent">This appeal is against the decision of the High Court of Gombe State in </span><strong><u><span style="background-color: transparent">CHARGE NO. GM/73C/2015</span></u></strong><span style="background-color: transparent"> wherein it convicted the Appellant and his co-accused person for the offences charged. The Charge against the Appellant is as follows:</span></p><p class="ql-align-justify"><strong><em><span style="background-color: transparent">“</span></em></strong><strong><em><u><span style="background-color: transparent">COUNT 1</span></u></em></strong></p><p class="ql-align-justify"><em><span style="background-color: transparent">That you (1) Mohammed Sani and (2) Musa Mohammed on or about 6th of April 2014 at Arawa/Mallam Inna quarters Gombe in the Gombe metropolis within the jurisdiction of this court, agreed to do an illegal act to wit: cause grievous hurt. And the same act was done in pursuance of the agreement, you attacked and inflicted serious injuries on one Ibrahim Sani and Wujuri Asilale.
