Judgement

FREDERICK OZIAKPONO OHO, J.C.A.(Delivering the Leading Judgment): This is an Appeal against the Judgment of the High Court of Sokoto State sitting at Sokoto in which the Appellant, JAHO MOHAMMED along with others were arraigned on three (3) counts charge for the offences of criminal conspiracy, armed robbery and culpable Homicide punishable with death contrary to Sections 97; 298 (c) and 221 of the Penal Code law respectively. At the conclusion of trial the Appellant along with one SANI LAWALI DANCHINA were upon conviction sentenced to death by hanging.

At the trial the Prosecution called a total of seven (7) witnesses in its bid to prove its case while the Appellant testified for himself and called no witnesses. At the conclusion of trial, the lower Court ordered the filing of final written addresses of Counsel which were subsequently adopted by Counsel for the parties.
