OBANDE FESTUS OGBUINYA, J.C.A. (Delivering the Leading Judgment): This appeal probes into the correctness of the decision of the High Court of Ondo State, sitting in Akure (hereinafter referred to as "the lower Court"), coram judice: D.I. Kolawole, J., in Suit No: AK/260/2010, delivered on 26th July, 2011. The appellants and the respondents were the respective plaintiffs and defendants before the lower Court.
The facts of the case, which transformed into the appeal, are submissive to brevity and easy appreciation. The Chieftaincy throne of Ikare land is litigation-friendly. This appeal germinated from one of such cases. The appellants alleged that the first appellant is the reigning Oba and the paramount ruler of Ikare land with the attendant rights, privileges and obligations attached to the traditional stool.
