RITA NOSAKHARE PEMU, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of the Customary Court of Appeal Anambra State holden at Awka, on the 28th, April 2014, whereby the Court dismissed the appellant appeal against the Ruling of the Customary Court Agbaja, Nnewi that it has jurisdiction to entertain the suit which was before it.
The appellant, dissatisfied with the judgment has appealed it.
Pursuant to the Practice Direction of this Honourable Court, the Appellants filed their Notice of Appeal on the 23rd of May 2014pages 109 111 of the record of Appeal.
SYNOPSIS OF FACTS
The Appellants were defendants in the suit at the Customary Court Agbaja Nnewi. The Respondent had instituted the suit against them as plaintiff, whereby he claimed against the Appellants jointly and severally as follows:
