Judgement

BY COURT: RULING

1. Having heard Counsel for Plaintiff on the relationship that exist between 2nd defendant and the 1st defendant (a legal person), I am of the view that as provided in Section 263 of the Company’s Act 1963 (ACT. 179), the 2nd Defendant is in the class of persons who could act for the 1st Defendant and could sue and be sued in respect of the activities or acts of the 1st Defendant. And therefore Augustina Oku who presented herself as representing the 2nd Defendant is an agent of the Defendants. The Defendants are therefore fixed with knowledge that this case will be called today for the business of fixing a date for mini trial to be conducted or agreed on.

2. This case is adjourned to 15/11/2018 for mini trial to commence.
