TUNDE OYEBAMIJI AWOTOYE, JCA (Delivering the Leading Judgment): This is the Judgment in respect of the Appeal filed by the Appellants against the Judgment of Rivers State High Court delivered on 5/10/2015 in Suit No. OHC/55/2013. The Claimants are the Respondents in this Appeal. The Defendants at the lower Court are now the Appellants. The Claimants had instituted an action against the Defendants claiming as per paragraph 20 of their Statement of Claim thus:

(i) A Declaration that the committee headed by the 1st Defendant was constituted in bad faith and that they are usurpers of the functions of the Claimants as contact men for Mgbede 16 Location.

(ii) An Order or perpetual injunction restraining the 1st Defendants from further interfering with the functions of the Claimants as contact-men for Mgbede 16 Location.

(iii) An Order of Court directing or compelling the 2nd Defendant to transact with, and negotiate with the Claimants who are the accredited contact men for Megbede 16 Locati…
