YAHAYA BAUSHE MUHAMMADU V. THE STATE

OKORO, J.S.C. (Delivering the Leading Judgment): This appeal is against the judgment of the Court of Appeal holden at Kaduna, delivered on the 14th day of December, 2016 which dismissed the appellant's appeal and affirmed the judgment of the learned trial Judge. The appellant was arraigned before the Jigawa State High Court sitting at Dutse on a one count charge of rape punishable under section 283 of the Penal Code, Cap P3, Laws of Jigawa State, 2012 (as amended).

The appellant was tried, convicted and sentenced to seven years imprisonment without option of fine by the learned trial Judge in his judgment delivered on 30th June, 2016.

Dissatisfied with the judgment of the learned trial Judge,the appellant filed an appeal before the Court of Appeal, Kaduna,which after hearing, dismissed the appeal for lacking in merit on 14th December, 2016.
