<p>OLUDOTUN ADEBOLA ADEFOPE-OKOJIE, J.C.A.(Delivering the Leading Judgment): This is an appeal against the decision of the Kaduna State High Court delivered on 15th Nov. 2014, by Hon. Justice B.F. Zubairu. Dissatisfied, the Appellant appealed to this Court.</p><p>The facts leading to this appeal are that the Respondent, as Plaintiff before the lower Court, filed a Writ of Summons to recover a credit facility granted to the Non-Academic Staff Union (NAPRI) ABU (the 1st Defendant before the lower Court), in the sum of N17,002,375.74 (Seventeen Million, Two Thousand, Three Hundred Seventy Five Naira, Seventy Four Kobo) alleged to be owing, with interest of 22% at the prevailing bank rate from the 22nd January, 2013 until judgment.</p><p>The Respondent filed in addition a Statement of Claim, together with an application for summary judgment, seeking entry of judgment in the said sum.
