(Delivering the Leading Judgment): This is an appeal against the judgment of the Customary Court of Appeal, Adamawa State sitting in Yola (lower Court) delivered on 13/11/24 constituted by James Audu Balami, J. (President), E. Momsisuri Bemare Odo, J., Evaristus Paul, J., and Adabala Dicholas, J., which set aside the judgment of Upper Area Court, Gombi (trial Court) in Suit No: UAC/GMB/ADJS/85/2021 delivered by Hon. Sadiq Giwa on 26/06/23 wherein the trial Court dismissed in its entirety the Respondent's claims and found for the Appellant. The Notice of Appeal which initiated this appeal was filed on 27/01/25 and contains 3 grounds of appeal against the decision of the trial Court. The Record of Appeal was transmitted on 28/03/25, paving the way for the filing of the Appellant's Brief of Argument on 08/04/25. This was settled by Fati Watafua, Esq.
