UBAEZONU, JCA (Delivering the Lead Judgment): The plaintiffs who are the respondents in this appeal sued the defendants who are the appellants. The suit was commenced in the High Court of Awka Judicial Division of Anambra State claiming as follows: “(a) A declaration that the plaintiffs are entitled to the customary right of occupancy over all that piece and parcel of land known as “Okudugbo” and lying and situate at Adazi-Nnukwu between the Idozu River and the area pledged by the plaintiffs to the defendants. The annual rental value of the said piece of land is N10.00.

A declaration that the defendants are customary pledgees to the plaintiffs with respect to the piece of land lying south of the plaintiffs “Odongwo” at the bank of the Idozu River. N50,000.00 (Fifty Thousand Naira) general damages for the acts of trespass committed by the defendants over the plaintiffs’
