TUNDE OYEBANJI AWOTOYE, J.C.A. (Delivering the Leading Judgment): This is the judgment in respect of the appeal of the Applicant (now Appellant) against the decision of Federal High Court, Owerri Division delivered on 28/4/2016.
The Applicant had filed an application for the enforcement of Fundamental Right to liberty at the lower Court seeking for the following reliefs:
a. A declaration of the Honourable Court that the continued summons/invitations on phone calls and text messages on the Applicant reports back to the Commission unfailingly by the 2nd to 4th Respondents on an issue that have been determined by a Court of competent jurisdiction in suit No. E/962/2004 C.V. NDUNAGU v. APEX SECURITIES LTD, is a conduct likely to contravene the Applicants fundamental Right to liberty guaranteed under Section 35 of the 1999 Constitution as well as Article 6 of the African Charter on Human and Peoples Right (Enforcement and Ratification) Act Cap 10.
