TUR JCA (Delivering the Lead Judgment): The appeal is against thejudgment of WadaAbubakar Omar Rano J., of the High Court of Justice, Kano, Kano State delivered on 7 May 2004 in favour of the plaintiffs/ respondents in a suit founded on the enforcement of the fundamental rights of the respondents/plaintiffs wherein his lordship awarded N100,000.00 (one hundred thousand naira) to the respondents against the appellants/defendants for causing their unlawful arrest and detention by the police in what was considered purely a breach of a contractual obligation.

The facts before the learned trial judge were as follows: The 1st and 2nd respondents were partners carrying on the business of estate agents under the name and style of “The Place Agency” in Kano.
