Judgement

ALAGOA JCA (Delivering the Lead Judgment): This is an appeal by the Niger-Benue Transport Company Ltd, Warri against the judgment of Onajite Kuejabola J of the High Court of Justice, Warri, Delta State dated the 16 March 1998. The respondent, Godstime Okeke as plaintiff at the trial court had claimed against the appellant as defendant as follows: “The plaintiff’s claim against the defendant is for the sum of N2,500,000.00 (two million, five hundred thousand naira) being special and general damages suffered by the plaintiff when the defendant by a letter dated 19 November 1994 purportedly terminated the employment of the plaintiff without having regard for the subsisting and valid collective agreement between the parties dated the 1 June 1992 and both plaintiff and defendant reside in Warri, a place within the jurisdiction of this court.
