Judgement

MASSOUD ABDULRAHMAN OREDOLA, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Federal High Court of Nigeria, sitting at Owerri (hereinafter referred to as the lower Court).The said judgment was delivered on the 26th day of October, 2015 in Suit No. FHC/OW/CS/04/2014, Coram: Hon. Justice O. O. Oguntoyinbo, J., (hereinafter referred to as the learned trial judge).

The suit which gave rise to this appeal was initiated by the plaintiffs/respondents (hereinafter called the respondents) at the lower Court, vide a writ of summons and other originating processes filed on the 4th day of February, 2014, wherein the respondents by their statement of claim sought for the grant of the following relief:

"The payment of Fifty Million Naira (N50M) being fair and adequate compensation for the loss of inherited fishing rights, inconveniences, and for the injurious affection suffered as a result of Defendant oil spill and burning of the Agbo Nnuru creek and adjoining…
