Judgement

The 1st Defendant stated she has made a search and found that counsel for Plaintiff is not a registered solicitor hence the application.

She also stated she has annexed Exhibit “FA “A” and Exhibit “FA “B”, which are a responses from the General legal council and a Ruling in the case Ex parte Teriwajah.

BY COURT: R U L I N G

1. This court has heard 1st Defendant on her motion and has perused the motion paper and the deposition in support.

Exhibits “FA” and “B” annexed are apposite, and corroborate the averments of the applicant. And I find and hold that lawyer Tawiah Yoyowah is not licensed to practice law at the relevant dates mentioned in the letter from the General legal counsel.

Indeed, the writ taken on 08-10-2018 has no solicitors’ license endorsed on it.

This being the case Ex parte Teriwajah and another similar cases are applicable.

This action commenced without compliance with section 8(2) of Act 32, the legal Profession Act is a nullity and I declare it as such.
