Judgement

ONIYANGI JCA (Delivering the Lead Judgment): The appellant was arraigned, tried, found guilty, convicted and sentenced to death by hanging for committing an offence of conspiracy to commit armed robbery contrary to section 6(b) and punishable under sections 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, Cap. R11, Vol. 14, Laws of the Federation of Nigeria, 2004. In order to establish its case against the appellant, the prosecutioncalled three witnesses and tendered in evidence as exhibits, statements of the appellant and his cohort who have given up the ghost. The prosecution’s case in brief is that one Mr. Jude Chika, a businessman (PW 2) trading under the name and style of Chikason Co. Ltd. in Benin Cit y on 30 March 2010 gave the sum ofN1,400.000.00 (one million, four hundred thousand naira) to his secretary, Nnenna to deposit in an account maintained by him with the G.T.
