Judgement

ABDULLAHI JCA (Delivering the Lead Ruling): The application dated and filed on 1 June 2007 by the 1st appellant/applicant is by way of motion on notice to the respondents, praying for the following orders: “1. An order regularizing the amended notice and grounds of appeal filed by the 1st appellant/applicant on 19 February 2002 wherefor the reassessed filing fee of N510.00 (five hundred and ten naira) was paid on 4 October 2005.

An order deeming the briefs of argument previously filed and served by the appellants and respondents as properly filed and served. And for such further orders as this honourable court may deem fit to make in the circumstance.”

The grounds upon which the application is brought are:

“1. That the 1st appellant/applicant discovered an error or omission by the court registrar, in assessing the filing fee on the amended notice and grounds of appeal filed on 19 February 2002 upon which the correct fee was subsequently assessed by the registrar and paid by the 1st app…
